that may be exactly why they couldn't get it on there, either. Image comics is, from what I gather, a separate company from both Marvel and D.C.. And even though Fox Kids cancelled production on it, that doesn't mean they stopped holding the rights to the material Roustabout had produced, considering this was conceived as something to specifically go on this network (if I'm understanding correctly what the person who wrote this article is saying).
it's actually quite likely that whatever Roustabout made of this is sitting in a Fox vault somewhere, under disney's lock and key, lol.
